Please read these Terms of Service (“Terms”) carefully before using the Music Player mobile application (the “App”) operated by us (“we”, “us”, or “our”). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.​

1. Use of the App

1.1 License

We grant you a limited, non‑exclusive, non‑transferable, revocable license to install and use the App on your personal Android device for private, non‑commercial purposes, subject to these Terms and any applicable store rules (e.g., Google Play Terms of Service).​

1.2 Restrictions

You agree that you will not:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.

  • Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the App, except where such restrictions are prohibited by law.​

  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.

  • Use the App to upload, transmit, or distribute viruses, malware, or other harmful code.

  • Attempt to gain unauthorized access to the App, its servers, or related systems or networks.

  • Use any automated means (including bots, scripts, or scrapers) to access or interact with the App.

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

  • Interfere with or disrupt the operation of the App, servers, or networks connected to the App.

2. Music playback and content

2.1 Local media only

The App is designed to play and manage audio files stored locally on your device or accessible storage; it does not provide or sell music content itself.​

2.2 Your responsibility for content

You are solely responsible for ensuring that you have the necessary rights to any audio files you use with the App and for complying with applicable copyright and licensing laws when playing or distributing music.​

3. User content

3.1 Your responsibility

You are solely responsible for:

  • All content you access or play through the App (including songs, recordings, and playlists).

  • Ensuring that your use of the App does not infringe the rights of third parties or violate any laws.

3.2 Prohibited content

You may not use the App in connection with any content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

  • Infringes any copyright, trademark, or other intellectual property or proprietary right.

  • Is intended to harass, intimidate, or harm others.

  • Promotes violence, hatred, or discrimination.

4. Intellectual property

4.1 Our rights

The App (including its code, design, logos, text, graphics, and other elements) is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.​

4.2 Your rights

You retain ownership of your audio files and any playlists or metadata you create. By using the App, you grant us a limited right to process such content solely as necessary to provide the App’s functionality on your device.

5. Third‑party services

The App may use or interact with third‑party services such as analytics, crash reporting, or operating system services. Your use of such third‑party services may be subject to their own terms of service and privacy policies, and we are not responsible for their content, availability, or practices.​

6. Availability and modifications

6.1 Service availability

We strive to keep the App available and functional but do not guarantee:

  • That the App will be uninterrupted, secure, or error‑free.

  • That defects will be corrected.

  • That the App or the server(s) used are free of viruses or other harmful components.​

6.2 Modifications

We reserve the right to:

  • Modify, update, or discontinue the App (or any part or feature) at any time, with or without notice.

  • Update these Terms from time to time.

If you continue to use the App after changes become effective, you are deemed to have accepted the updated Terms.​

7. Disclaimer of warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.​

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP.

  • ANY UNAUTHORIZED ACCESS TO OR USE OF SERVERS OR ANY PERSONAL INFORMATION.

  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP.

  • ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY.

  • ANY ERRORS OR OMISSIONS IN THE APP OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY FUNCTIONALITY.

IN ANY CASE, OUR TOTAL AGGREGATE LIABILITY IN RESPECT OF ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE APP WILL BE LIMITED TO THE AMOUNT (IF ANY) YOU PAID FOR THE APP.​

9. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.​

10. Age restrictions

The App is not intended for individuals under the age of 13. By using the App, you represent and warrant that you are at least 13 years old or that you have the consent of a parent or legal guardian where required by applicable law.​

11. Governing law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict‑of‑law provisions.​

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe that you have violated these Terms or if we decide to discontinue the App. Upon termination, the rights granted to you under these Terms will immediately cease, and you must stop using and uninstall the App.​
